We have been involved in public sector labor law since the 1980s, always on the union/employee side. We are general counsel to the largest statewide police labor union in the state and many local police benevolent associations, representing them and their members in collective bargaining, contract administration, disciplinary matters, disability retirements and job-related personal injury claims. If you are a policeman or fireman in New York State, you have special rights not available to other employees in terms of collective bargaining, on-the-job injuries and disability retirements. You are entitled to binding arbitration of labor disputes, to recover against third-parties responsible for on-the-job injuries with no reduction for any fault on your part and to disability retirement benefits up to 75% of your salary tax free. Our experience can help you get all of those special benefits that you are entitled to.
Over the years, we have successfully handled cases in the New York and Federal Courts involving personal injuries and commercial disputes. A partial list of the types of cases we have handled in each area includes the following:
Employment Matters
Personal Injury Litigation:
Accidents of all types, amputations, bicycle injuries, boating injuries, brain injuries, burn injuries, car accidents, construction site accidents (Labor Law §§240 and 241) crush injuries, failure to diagnose fractured hip, failure to diagnose cancer, food poisoning cases, General Municipal Law §205-e claims, hospital injuries, highway maintenance /design cases, hip replacement failure cases, infant settlements, IUD cases, jail suicide cases, job-related injuries, listeria, Mirapex Litigation, medical malpractice, motorcycle accidents, nursing home injuries, orthopedic injuries, pedestrian accidents, post tramatic stress disorder (PTSD), premises liability, products liability, school/sports injuries, tainted food, tampon litigation, toxic substance/exposure injuries, traumatic brain injuries, truck accidents, vehicle maintenance, and wrongful death claims.
Mass Tort Litigation:
A mass tort occurs when a drug, medical device, consumer product or conduct causes the same or similar injuries to people over a broad geographic area. When enough lawsuits involving the same product are filed across the country, each proceeds as a separate lawsuit but they are consolidated for purposes of administration before a single court. This is called a multidistrict litigation or MDL. We’ve handled such litigation over the years in cases involving IUDs (pelvic inflammatory disease), tampons (toxic shock syndrome), Mirapex (prescribed for restless leg syndrome with various adverse side effects) and IVC filters and artificial hips. MDLs are complex proceedings that require a special nexus of knowledge, experience and connections to obtain successful outcomes. We have studied the current state of multidistrict litigation, and we are emphasazing that part of our practice at this time.
Commercial Matters and Litigation:
LLC formation, operation and dissolution, corporate counseling (business and not for profit), business acquisitions and sales, commercial litigation involving partnerships/LLCs, minority shareholder litigation, shareholder derivative litigation, real estate litigation, adverse possession, boundary line disputes, breach of contract, insurance coverage litigation, estate litigation, legal malpractice, securities litigation/arbitration, contested surrogates court matters, and all forms of alternative dispute resolution.
